1. About these terms

These Terms of Service ("Terms") govern your purchase of and participation in the financial education programs offered by Diéguez Smart Solutions ("we," "us," "our"). By enrolling in a program, submitting an inquiry, or paying a program fee, you agree to these Terms.

Please read the section titled "Nature of our services" carefully. It describes what our programs are and, just as importantly, what they are not.

2. Nature of our services

Participation in our programs does not guarantee an increase in a credit score, approval for financing, specific credit limits, loan approval, business funding, or any other financial outcome.

We do not make lending decisions and cannot influence the underwriting criteria or decisions of banks, lenders, credit bureaus, or other third parties.

We do not dispute information on your behalf with credit bureaus, creditors, or furnishers of information, and we do not offer credit repair services. Our programs explain how credit reporting, credit utilization, budgeting, cash flow, and lender qualification factors generally work so that you can make your own informed decisions.

Individual results and financial circumstances vary. You remain solely responsible for your own financial decisions and for implementing any educational strategies discussed during a program.

3. Programs and fees

Program fees are stated in U.S. dollars on our website and are for the educational services, materials, assessments, and consultations described in the program you select. Current programs and fees are:

• Personal Financial Education Program — $499
• Financial Wellness Academy — $999
• Financial Readiness Program — $1,499
• Business Financial Education Academy — $1,999

Fees are due at enrollment unless you select an available third-party financing option at checkout. We may change program contents or pricing at any time; changes do not affect programs already purchased.

4. Payment and third-party financing

You may pay in full at enrollment or, where available, use a third-party pay-over-time provider such as Affirm. Financing is offered, underwritten, and serviced entirely by the third-party provider and its lending partners, not by us.

If you use a third-party financing provider, your loan or payment plan is governed by that provider's own agreement with you. We do not make credit decisions, do not set rates or terms, and do not guarantee approval. Declined applications are decisions of the provider, not of Diéguez Smart Solutions.

Rates from 0–36% APR. Payment options through Affirm are subject to an eligibility check and are provided by these lending partners: affirm.com/lenders. Options depend on your purchase amount, and a down payment may be required.

5. Delivery of educational services

Programs are delivered remotely by video or telephone session, together with digital educational materials, unless otherwise agreed in writing. After your enrollment is confirmed, we will contact you within two business days to schedule your assessment and first session.

Sessions are scheduled by mutual agreement. If you need to reschedule, please give at least 24 hours' notice. Sessions missed without notice may be counted as delivered.

The 90-day and multi-session programs are delivered over the period described in the program listing, beginning on the date of your first scheduled session.

6. Your responsibilities

• Provide accurate information during assessments so that the educational content can be tailored to your situation.
• Attend scheduled sessions or reschedule them with reasonable notice.
• Make your own decisions about your finances, and seek advice from a licensed attorney, accountant, tax professional, or registered investment adviser where such advice is required.
• Keep your account credentials and educational materials for your own use.

7. Intellectual property

All workbooks, assessments, roadmaps, presentations, templates, and other materials we provide remain our intellectual property and are licensed to you for your own personal or internal business use. You may not resell, redistribute, publish, or use them to deliver competing programs.

8. Cancellations and refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

9. No guarantee; limitation of liability

Our programs are provided "as is" for educational purposes. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, and we make no representation that participation will produce any particular financial, credit, or lending outcome.

To the maximum extent permitted by law, our total liability arising out of or relating to a program is limited to the amount of the program fee you actually paid. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost funding, or lost credit opportunities.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Lee County, Florida, and you and we consent to the jurisdiction of those courts.

11. Changes to these terms

We may update these Terms from time to time. The version in effect at the time you enroll applies to that enrollment. Updated versions are posted on this page with a revised "last updated" date.
